TERMS AND CONDITIONS

 1. Introduction 
 
1.1 These terms & conditions set out the terms between you the customer and us the website owner.
 
1.2 Your use of this website and any service contained within constitutes acceptance of these terms & conditions in full.
 
1.3 You should not use this website if you do not accept these terms & conditions in full.
 
2. General
 
2.1 Best Fireworks Direct are committed to the safe and legal sale of fireworks. 
 
2.2  All firework products available from BFD comply with the British Standards BS7114 Part 2: 1988. The sale of such items are subject to the Explosives Act 1875, Health and Safety Act 1994, Manufacture and Storage of Explosive Regulations 2005, Fireworks Regulations 2004, and any subsequent statutory, legislation or re-enactment / modification.
 
2. 3 It is illegal to sell fireworks to anyone under the age of 18. 
 
2. 4 It is illegal for anyone under the age of 18 to be in possession of fireworks in a public place.
 
2. 5  All firework products should be used safely and responsibly. Please refer to our firework safety page for further guidelines and pay close attention to all safety instructions provided on firework packaging.
 
2.6 We shall not be responsible for any breach of the Terms and Conditions caused by circumstances beyond our reasonable control.
 
3. Customer 
 
3.1 Our website is only intended for use by adults. Adults may purchase products for children as long as the products purchased are intended by the manufacturer for use or consumption by children.
 
3.2 You should always check that the contact information you provide is correct before proceeding and confirming payment. 
 
3.3. You, the buyer, must ensure adequate and relevant insurance is in place for firework related matters.
 
4. Pricing and Personal Information:
 
4.1 All prices are stated in pounds, inclusive of current VAT rates.
 
4.2 We reserve the right to alter all product pricing without notice.
 
4.3 Once we receive your personal information, it is stored on secure servers.
 
4.4 Personal Information received by BFD will never be passed to a third party other than delivery details (if products are ordered via our Mail Order department) to the courier company transporting our products or if they are required by a law enforcement agency.
 
5. Stock:
 
5.1 All offers are subject to availability and while stocks last. 
 
5.2 We reserve the right to substitute any out of stock items. Replacement items will be valued either the same or greater than that of the original item price.
 
6. Damaged Products and Misfiring:
 
6.1 If you consider your goods to be defective in any way, please notify us immediately via email or post, stating the issue and providing a contact telephone number. Upon receiving the complaint, a member of our customer service team will contact you as soon as possible to discuss the matter accordingly.

 6.2 Reasonable care must be exercised when using all firework products (as stated in the General Section) and therefore BFD will not be held liable for any damages or costs associated with the misuse of fireworks.
 
6.3 If the defect is caused by misuse, negligence or failure of you to follow the provided instructions regarding the storage, commissioning, installation, use and maintenance of the goods, it will not be classed as the manufacturer’s liability. 
 

6.4  Should one of our products fail to function properly, a replacement product (if confirmed by BFD) may be issued provided evidence of failure is present.

6.5 In this unlikely case, we advise you to leave the particular firework where it is and do not return to it for at least 12 hours. After that, take photos of the firework/misfire for your reference and send these to us so we can investigate further and liaise with the manufacturer. We find the best way to dispose of mis-firing fireworks is to soak them in a bucket for 2-3 days then discard properly (for more information please call your local Fire Station/Fire Officer for advice). Once we have authenticated the misfiring firework we will then replace the item. (Please see our firework safety page for more information). 

 
7. Additional Mail Order T&C’s:
 
Payment:
 
7.1 We accept payment by Visa, Mastercard and Paypal. We do not accept payment from American Express or cards registered outside the UK. 
 
7.2 Although some personal information is stored on secure servers, no credit card details are stored.
 
7.3 If there is a problem taking payment for all or any part of your order, we will contact you by telephone or email. If the problem is associated with security authorisation of payment, we will look into this when we process the order. Goods will not be dispatched until we have obtained the required security checks and this may delay the delivery of your order, for which BFD will not be liable. 
 
7.4 If we decline an order which has already been paid for, we will refund the full amount received by BFD.
 
8. Delivery: *For more detailed information regarding delivery arrangements and prices, please contact BFD via telephone.
 
8.1 We only deliver to addresses within mainland England, we cannot deliver to Northern Ireland, the Channel Islands or the Isle of Man via our Mail Order site.
 
8.2 Delivery will be made to the address specified when completing your order and the delivery charge will depend on the delivery method and date. This amount is calculated and displayed at the online checkout. 
 
8.3 Delivery to secondary addresses will require proof of card holder’s registered address.
 
8.4 We will make every effort to deliver your order within the timeframe selected at checkout. Unfortunately we cannot guarantee the date of your delivery and BFD will not be liable for the failure of the delivery due to: circumstances beyond our control, or the customer’s failure to provide BFD with adequate information regarding the supply of goods. We shall contact you to let you know if we are having any problems delivering an item to you within the relevant time frame.
 
8.5 On delivery, if no one aged 18 or over is present, the goods will be returned to BFD and you will be required to pay for the re-delivery of your order.
 
8.6 If you are unable to accept the delivery, we will not refund any charges relating to the failed delivery.
 
8.7 Some orders may arrive in multiple parts. If this is the case, you will be notified of delivery details as soon as possible.
 
8.8 When the item(s) have been delivered, the responsibility of the item(s) passes to you.
 
8.9 Due to a heavy workload around 5th November – orders must be placed prior to 28th October to guarantee delivery for Bonfire Night. Orders must be placed prior to 23rd December to guarantee delivery for Christmas Day. And prior to 28th December to guarantee delivery for New Year’s Eve. Click & Collect orders can still be placed within this time frame. No deliveries will be made after these dates. If an order is placed within this period and arrives after Bonfire Night/Christmas/New Year’s Eve we have the right to refuse a refund. 
 
9. Online Cancellation Rights, Returns and Refunds
 
9.1  Under the Consumer Protection (Distance Selling) Regulations 2000 you have a right to cancel your order before it has been dispatched. To exercise this right you must notify us in writing (email or letter).

9.2 As stated above, notification of cancellation must be in writing, a telephone call is not a valid cancellation.
 
9.3 If the items have not been dispatched from BFD we will cancel the order and refund the full payment.
 
9.4 If the items have been dispatched and we are unable to stop the delivery, you can refuse to sign for the products. This will return the items to BFD and we can refund the payment (within 30 days of the cancellation) excluding all delivery charges, plus a 20% restocking fee.  
 
9.5 All our hazardous items cannot be returned once purchased and all sales are final. This is due to the nature of the products which cannot be resold once they have been in the hands of the consumer (as they could potentially be damaged or tampered with). 

 

10. Additional Click and Collect T&C’s:

Our Click and Collect department allows you to pre-order items for collection by you from the retail store.
 
10.1 Items ordered from the Click & Collect department are never delivered to any address.
 
10.2 You agree to purchase the total order unless you are unhappy with a substitute product (when some items are out of stock we may substitute a similar product).
 
10.3 We reserve the right to cancel the order and/or refuse to serve any customer at our discretion.
 
10.4 Orders will be cancelled under the following circumstances:
 
10.5 The person purchasing the fireworks is believed to be under the age of 18. This is a legal requirement and is non-negotiable.
 
10.6 Thought to be fraudulent in any manner.
 
10.7 Items are not picked up at the arranged date/time. Please note that you will be charged a 20% restocking fee if orders are placed and not collected.
 
10.8 Orders placed via Click & Collect have to be picked up within 7 days of ordering (unless you have arranged an alternative collection date with us). After this period, we cannot guarantee the availability of items. If you change your mind and wish to cancel your Click & Collect order after the 7 day collection period, you will be refunded, minus a 20% restocking fee). 
 

10.9 By placing an order for collection via our Click and Collect department, you agree to these terms and conditions.

11. Copyright

11.1 All content, databases, graphics, buttons, icons, logos, layouts and look & feel are our copyright, unless expressly acknowledged as otherwise.
 
11.2 The data mining, extraction or utilisation of product information from our website is not permitted without our express prior written permission.
 
12. Variation
 
12.1 We reserve the right to vary these terms & conditions at any time, without giving notice to you. Such varied terms and conditions shall automatically apply to the use of our website from the date of publication on our website.
